The Supreme Court of Justice (SCJ) presented the Implementation Plan of Law No. 02-23 on Cassation Appeals, a project aimed at developing a series of actions that will allow this high court to make effective the application of the new regulation.
The Plan was presented during the recent meeting of the "Transform Justice Route" of the Judicial Branch, whose initiative is in harmony with the thematic line of 0% Mora for a Timely and Efficient Justice.
"The objective of the plan is to effectively carry out the implementation of the cassation regulations, to achieve a prompt, pertinent and efficient justice service, with quality criteria, optimized processes, establishing ways, mechanisms and regulations that avoid judicial delay", said Judge Napoleon Estevez Lavandier, who presides the Commission of the Implementation Plan of the Cassation Law.
Likewise, Estévez Lavandier, who exercises his jurisdictional work as judge of the First Chamber of the SCJ, indicated that the actions are being developed in different components that will continue to make it possible to promote the changes that are needed to effectively implement the new provisions of the cassation procedure.
The Secretary General of the Supreme Court of Justice, Mr. César García Lucas, explained that, in the normative area, the procedure for the suspension of the execution of the sentence appealed in cassation was regulated and the First Non-Jurisdictional Plenary Agreement was carried out in both the First and Third Chambers of the Supreme Court of Justice.
In addition, it is contemplated to establish a Data Protection Policy in the Judiciary applicable to the publication of the decisions of the Supreme Court of Justice, weighing the right to information and transparency, with the fundamental right to data protection, in addition to the reduction of the use of dispensable personal data in the decisions of the courts and tribunals of the Republic.
He also informed that in the process component, the process manuals of the General Secretariat of the Supreme Court of Justice are being updated to adapt it to Law 2-23.
Similarly, as part of the technological improvements, the Case Management System is being updated, including mechanisms for monitoring and controlling deadlines that will allow users to see the status of their files in real time.
Another of the actions being developed includes a series of external and internal trainings aimed at improving the performance and correct application of the cassation law, which would be developed through the National School of the Judiciary (ENJ).
As part of the improvements to be implemented with respect to the advanced search of decisions in the institutional web portal, a tool is being designed that will serve as a knowledge base that will allow the publication and intelligent search of jurisprudence of the SCJ, Superior Administrative Court, Courts of Appeal at the national level and decisions of the Courts of First Instance that serve as appellate courts.This is done in coordination with the National School of the Judiciary (ENJ).
The meeting "Ruta Transforma Justicia" of the Judicial Branch was attended by judges, judicial servants, key actors of the justice system and the legal community, social and trade organizations, academia and representatives of international leadership.
