These Policies (hereinafter, the "Policies") condition the use of the services of the Internet portal www.poderjudicial.gob.do (hereinafter, the "Portal") of the Judicial Branch of the Dominican Republic, one of the three branches of the State that make up the government of the nation, Its function is to administer justice, free of charge, to decide on conflicts between individuals or legal entities, in private or public law, in all types of processes, judging and enforcing what is judged. Its exercise corresponds to the courts and tribunals determined by law, with domicile and main offices at Av. Jiménez Moya, corner Juan de Dios Ventura Simó, Centro de los Héroes de. Constanza, Maimon and Estero Hondo, Santo Domingo, National District, Dominican Republic.
Conditions
Minors
In order to make use of the Services that require the collection of Personal Data by the Judicial Branch through the Portal, minors must obtain prior permission from their parents, guardians or legal representatives, who will be considered responsible for all acts performed by minors under their responsibility.
Obligation to make proper use of the Portal and the Services.
The User agrees to use the Portal and the Services in accordance with the law, these Policies, the Terms of Use, the Particular Conditions of certain Services and other notices and instructions made known to him/her, as well as public order, morality and generally accepted good customs.
The User shall refrain from obtaining and even attempting to obtain the Contents by using means or procedures other than those which, as the case may be, have been made available for this purpose or have been indicated on the Web pages where the contents are located or, in general, those which are normally used on the Internet, provided that they do not entail a risk of damage or disablement of the Portal, the Services and/or the contents.
The User or third parties harmed by the receipt of unsolicited messages addressed to a number of persons may notify the Judicial Branch by sending a message to the following e-mail address: contacto@poderjudicial.gob.do.
No License
All trademarks, commercial names or distinctive signs of any kind that appear in the Portal are property of the Judicial Power or of third parties, without it being understood that the use or access to the Portal and/or the Services attributes to the User any right over the aforementioned distinctive signs.
Likewise, the Contents are the intellectual property of the Judicial Power or third parties, without being understood as assigned to the User, by virtue of what is established in these Policies, any of the exploitation rights that exist or may exist on said contents beyond what is strictly necessary for the correct use of the Portal and the Services, that is to say, the User may consult, copy and store in the hard disk of his/her computer or in any other physical support, print or reproduce the material available in this Web page, exclusively for his/her personal or private use, or that which is carried out within his/her company or organization, making mention at all times of the property owned by the Judicial Power, being strictly forbidden to make alterations, modifications or decompilation of its content.
The commercialization in any form and under any title of the material contained in this site is strictly prohibited without the prior written authorization of the Judicial Branch. This portal may contain information from other sources, so in these cases, the consent of these sources must be required for its reproduction or commercialization.
Disclaimer of warranties and liability
Availability and continuity, usefulness and fallibility.
The Judicial Branch does not guarantee the availability and continuity of the operation of the Portal and the Services. Whenever reasonably possible, the Judicial Branch will give prior warning of any interruptions in the operation of the Portal and the Services. Nor does the Judicial Branch guarantee the usefulness of the Portal and the Services for the performance of any specific activity, nor its infallibility and, in particular, although not exclusively, that the User may effectively use the Portal and the Services, access the different Web pages that make up the Portal or those from which the Services are provided.
The JUDICIAL POWER EXCLUDES ANY LIABILITY FOR ANY DAMAGES OF ANY NATURE THAT MAY BE DUE TO THE LACK OF AVAILABILITY OR CONTINUITY OF THE FUNCTIONING OF THE PORTAL AND/OR THE SERVICES, TO THE FAILURE OF THE UTILITY THAT THE USER MAY HAVE ATTRIBUTED TO THE PORTAL AND/OR THE SERVICES, TO THE FALLIBILITY OF THE PORTAL AND/OR THE SERVICES, AND IN PARTICULAR, BUT NOT EXCLUSIVELY, TO FAILURES IN THE ACCESS TO THE DIFFERENT WEB PAGES OF THE PORTAL OR TO THOSE FROM WHICH THE SERVICES ARE PROVIDED.
Privacy and security in the use of the Portal and the Services.
The Judicial Branch does not guarantee the privacy and security of the use of the Portal and the Services and, in particular, does not guarantee that unauthorized third parties cannot have knowledge of the type, conditions, characteristics and circumstances of the use that the User makes of the Portal and the Services.
Quality
The Judicial Power does not control or guarantee the absence of viruses or other elements in the Contents that may cause alterations in your computer system (software and hardware) or in the electronic documents and files stored in your computer system.
Truthfulness, accuracy and timeliness
THE JUDICIARY EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MAY BE GENERATED BY THE LACK OF TRUTHFULNESS, ACCURACY AND/OR TIMELINESS OF THE CONTENTS.
Legitimacy, reliability and usefulness
The Judicial Power does not guarantee the legality, reliability and usefulness of the services provided by third parties through the Portal. THE JUDICIARY EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY NATURE THAT MAY BE GENERATED BY THE SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL.
Procedure in the event of unlawful activities
In the event that any User or third party considers that there are facts or circumstances that reveal the unlawful nature of the use of any content and/or the performance of any activity on the Web pages included or accessible through the Portal, and, in particular, the violation of intellectual property rights or other rights, he/she must send a notification to the Judiciary expressing the following:
Personal data of the claimant: name, identity card number (or passport number, in case of foreigners), address, telephone number and e-mail address; Specification of the alleged unlawful activity carried out on the Portal and, in particular, in the case of an alleged violation of rights, precise and concrete indication of the protected contents as well as their location on the Web pages;
Facts or circumstances revealing the unlawful nature of such activity
In case of infringement of rights, handwritten signature or equivalent, with the Personal Data of the holder of the allegedly infringed rights or of the person authorized to act in the name and on behalf of such holder;
Express declaration, clear and under the responsibility of the claimant that the information provided in the notification is accurate and of the unlawful nature of the use of the contents or the performance of the activities described.

All notices and communications (hereinafter, the "Notices") by the User to the Judiciary shall be deemed effective, for all purposes, when sent to us by courier to the following address: Av. Applicable legislation
This Policy is governed in each and every one of its parts by the laws of the Dominican Republic.
Jurisdiction
The Judiciary and the User, with tacit waiver of any other jurisdiction, submit to the courts of the Dominican Republic.
