
In accordance with the provisions of the Law, it is the responsibility of the Secretary General of the Council of the Judiciary to prepare the Minutes of the sessions.
Resolution No. 009/2019, which approves the Internal Administrative Control Regulations of the Judicial Branch Council establishes the following:
Minutes of the sessions.
Minutes shall be taken of each meeting of the Judicial Council. The format of the minutes of the sessions shall conform to a form to be approved by the Council, which shall include at least: date and time of the session, place where it is held, agenda of the day, list of members present, enumeration of the topics that comprise it, the points of deliberation and agreements adopted with indication of the form and sense of the votes of all the members and the exact time of its termination.
Paragraph I.
Each item included in the agenda must contain the support, reports, analysis, as applicable, of the recommendation or request made by the corresponding body.
Paragraph II.
The minutes shall specify whether the decision has been taken unanimously or by majority vote, and in the case of dissenting, dissenting or dissaved votes, shall contain an explanation of the sense of their vote in relation to the point dealt with.
Paragraph III.
Each decision in the minutes shall be reasoned and shall be drawn up by the Secretary General, which shall be signed at the next meeting of the Board, with the prior consent of all the Board Members.
Paragraph IV.
Each session agenda document shall be accompanied by the corresponding attendance sheet, which shall be signed by the members present.
Paragraph V.
The minutes will be numbered consecutively and will be available to the public through the institutional portal.
Publicity of the Minutes.
Once the minutes have been signed by the Councilors in attendance and the Secretary General, they will be made available to the public and their contents will be published on the Judicial Branch website.
Paragraph I.
The points of the minutes that could violate the privacy of the person, his honor and public image, as well as the presumption of innocence, which is proper to disciplinary proceedings and all those aspects that are reserved in accordance with the applicable legal provisions, as well as the due protection of fundamental rights, shall not be subject to publicity.
Paragraph II.
Once the Judicial Council has approved a resolution or regulation, the technical bodies of the Institution must be informed and it must be published on the website of the Judicial Branch, in accordance with the procedure established for this purpose by Law No. 107-13, on the Rights and Duties of Persons in their Relations with the Administration and Administrative Procedure.
