Terms of Use
The present terms of use (hereinafter titled as the "Terms of Use") and policies that regulate the use of the services of the Internet portal www.poderjudicial.gob.do (hereinafter, the "Portal") of the Judicial Power of the Dominican Republic (hereinafter, "The Judicial Power"), is one of the three powers of the State that make up the government of the nation, Its function is to administer justice, free of charge, to decide on conflicts between individuals or legal entities, in private or public law, in all types of processes, judging and enforcing what has been judged. Its exercise corresponds to the courts and tribunals determined by law, with domicile and main offices at Av. Jiménez Moya, corner Juan de Dios Ventura Simó, Centro de los Héroes de. Constanza, Maimon and Estero Hondo, Santo Domingo, National District, Dominican Republic.
The use of the Portal grants you the status of user of the Portal (hereinafter, the "User") and implies full and unreserved acceptance of each and every one of the provisions set forth in the Terms of Use and the Policies published by the Judicial Branch at the time the User accesses the Portal. Therefore, it is necessary for the User to carefully read these terms each time he/she uses the Portal, as it may be subject to change without prior notice.
1. Purpose
Through the Portal, the Judicial Branch provides Users with access to and use of the services, information and content (hereinafter, the "Services") made available by the Judicial Branch or third parties.
2. Conditions of Accessibility and Use of the Portal
- Free access and use of the Portal. The provision of the Services by the Judicial Branch is free of charge for the User. Notwithstanding the foregoing, some of the Services provided by the Judicial Branch through the Portal may be subject to the payment of a fee which would be established therein.
- User Registration. In general, the provision of the Services does not require prior subscription or registration on the part of the User, this will only apply in cases where the User requires to receive specific information.
- Truthfulness of the information. All information provided to the User through the Services must be truthful. Therefore, the User undertakes to guarantee the authenticity of the data provided as a result of the requirements of the forms necessary for the subscription of the Services. Likewise, it shall be the User's responsibility to keep all the information provided by the Judicial Power duly updated in such a way that it corresponds, at all times, to the User's real situation. In any case, the User shall be solely responsible for any false or inaccurate information provided and for any damages that may be caused to the Judicial Branch or third parties as a result of the information provided.
- Intellectual Property. The entire content of this Portal, whether texts, images, compilations, trademarks, logos, color combinations, or any other element, its structure and design, the selection and form of presentation of the materials included therein, and the programs necessary for its operation, access and use, are protected by intellectual property rights, owned by the Judicial Power or by third party licensors, which the User of this Portal must respect.
- The User of the Portal. The user must refrain from deleting, altering, evading or manipulating any protection device or security system that may be installed in it.
3. Protection of personal data.
In order to use some of the Services, the User must first provide the Judiciary with personal data (hereinafter, the "Personal Data").
The Judicial Branch will automatically process Personal Data for the purposes and under the conditions defined in its Privacy Policy.
The Judicial Branch does not guarantee the absence of viruses or other elements in the Services provided by third parties through the Portal that may cause alterations in the User's computer system (software and hardware) or in the electronic documents and/or databases of its computer system.
The Judicial Branch has adopted the security levels of protection it considers necessary and endeavors to install the technical means and measures of protection that may become necessary. However, the User must be aware that security measures on the Internet are not inviolable.
The Judicial Branch may use cookies when a User browses the Portal's Web sites and pages. The cookies that may be used on the websites and web pages of the Portal are only associated with the browser of a specific computer (an anonymous User), and do not in themselves provide the name and surname of the User. Thanks to the "cookies", it is possible for the Judicial Branch to recognize the browsers of registered Users (after they have registered for the first time), so that they do not have to register each time they visit the areas and Services reserved exclusively for them. The cookies used cannot read cookie files created by other providers. The User has the possibility to configure his browser to be warned on his screen of the reception of "cookies" and to prevent their installation on the hard disk.
In order to use the Portal, it is not indispensable to install the "cookies" sent by the Judicial Branch, notwithstanding the fact that in such case it may be necessary for the User to register each time he/she accesses a Service that requires prior registration.
