Terms of Use
Los presentes términos de uso (en lo adelante titulados como, los «Términos de Uso») y políticas que regulan el uso de los servicios del portal de Internet www.poderjudicial.gob.do(en lo adelante, el «Portal») del Poder Judicial de la República Dominicana (en lo adelante, “El Poder Judicial”), es uno de los tres poderes del Estado que conforman el gobierno de la nación, Su función consiste en administrar justicia, de manera gratuita, para decidir sobre los conflictos entre personas físicas o morales, en derecho privado o público, en todo tipo de procesos, juzgando y haciendo ejecutar lo juzgado. Su ejercicio corresponde a los tribunales y juzgados determinados por la ley, con domicilio y principales oficinas en la Av. Jiménez Moya, esquina Juan de Dios Ventura Simó, Centro de los Héroes de. Constanza, Maimón y Estero Hondo, Santo Domingo, Distrito Nacional, República Dominicana.
El uso del Portal le otorga la condición de usuario del Portal (en lo adelante, el «Usuario») e implica la aceptación plena y sin reservas de todas y cada una de las disposiciones establecidas en los Términos de Uso y las Políticas publicadas por el Poder Judicial al momento en que el Usuario acceda al Portal. Por lo tanto, se hace necesario que el Usuario lea detenidamente estos términos en cada ocasión en que utilice el Portal, ya que éste puede sufrir modificaciones, sin previo aviso.
1. Purpose
A través del Portal, el Poder Judicial facilita a los Usuarios el acceso y el uso de los servicios, informaciones y contenidos (en lo adelante, los «Servicios») colocados a disposición por el Poder Judicial o por terceros.
2. Conditions of Accessibility and Use of the Portal
- Free access and use of the Portal. The provision of the Services by the Judicial Branch is free of charge for the User. Notwithstanding the foregoing, some of the Services provided by the Judicial Branch through the Portal may be subject to the payment of a fee which would be established therein.
- User Registration. In general, the provision of the Services does not require prior subscription or registration on the part of the User, this will only apply in cases where the User requires to receive specific information.
- Truthfulness of the information. All information provided to the User through the Services must be truthful. Therefore, the User undertakes to guarantee the authenticity of the data provided as a result of the requirements of the forms necessary for the subscription of the Services. Likewise, it shall be the User's responsibility to keep all the information provided by the Judicial Power duly updated in such a way that it corresponds, at all times, to the User's real situation. In any case, the User shall be solely responsible for any false or inaccurate information provided and for any damages that may be caused to the Judicial Branch or third parties as a result of the information provided.
- Intellectual Property. The entire content of this Portal, whether texts, images, compilations, trademarks, logos, color combinations, or any other element, its structure and design, the selection and form of presentation of the materials included therein, and the programs necessary for its operation, access and use, are protected by intellectual property rights, owned by the Judicial Power or by third party licensors, which the User of this Portal must respect.
- The User of the Portal. The user must refrain from deleting, altering, evading or manipulating any protection device or security system that may be installed in it.
3. Protection of personal data.
Para utilizar algunos los Servicios, el Usuario debe facilitar previamente al Poder Judicial datos de carácter personal (en lo que sigue, los «Datos Personales»).
The Judicial Branch will automatically process Personal Data for the purposes and under the conditions defined in its Privacy Policy.
The Judicial Branch does not guarantee the absence of viruses or other elements in the Services provided by third parties through the Portal that may cause alterations in the User's computer system (software and hardware) or in the electronic documents and/or databases of its computer system.
The Judicial Branch has adopted the security levels of protection it considers necessary and endeavors to install the technical means and measures of protection that may become necessary. However, the User must be aware that security measures on the Internet are not inviolable.
El Poder Judicial puede utilizar cookies cuando un Usuario navega por los sitios y páginas Web del Portal. Las cookies que se puedan usar en los sitios y páginas Web del Portal se asocian únicamente con el navegador de un computador determinado (un Usuario anónimo), y no proporcionan en sí mismas el nombre y apellido del Usuario. Gracias a las «cookies», se hace posible que el Poder Judicial reconozca los navegadores de los Usuarios registrados (luego de que éstos se hayan registrado por primera vez), esto ayuda que no tengan que registrarse cada vez que visita las áreas y los Servicios reservados exclusivamente a ellos. Las «cookies» utilizadas no pueden leer archivos «cookie» creados por otros proveedores. El Usuario tiene la posibilidad de configurar su navegador para ser avisado en su pantalla de la recepción de «cookies» y para impedir la instalación de las mismas en el disco duro.
Para utilizar el Portal no es indispensable la instalación de las «cookies» enviadas por el Poder Judicial, sin perjuicio de que en tal caso puede ser necesario que el Usuario se registre cada vez que acceda a un Servicio que requiera un registro previo.
