What is the procedure for setting alimony?

The claim for alimony must be filed in the Justice of the Peace corresponding to the demarcation where the defendant in alimony resides or the closest to the plaintiff, it is presented before the corresponding prosecutor providing all the documents that prove the filiation (birth certificate of the minor and identity card of the mother) and expenses incurred by the minor, there a hearing is set to see if the parties can agree on the matter if this does not happen the court will issue a sentence on the matter using the data provided by the parties.

Procedure for filing a complaint or denunciation of a judge or judicial servant?

The Judicial Power Council is in charge of receiving complaints against judges who have committed misconduct in the exercise of their functions, and after the disciplinary process, it will refer them to the common justice in case a criminal offense is found.

What is the procedure for the attorney oath or exequatur application?

In order to be sworn in, the following requirements must be submitted to the General Secretariat of the SCJ: Requirements to be sworn in as a lawyer

 

    1. Photocopy of the Decree granting exequatur for the practice of law.
    2. Two 2 x 2 photographs.
    3. Certificate of life and custom issued by the Secretary of State of Interior and Police and if you are from a town at the Governor's Office.
    4. Certificate of non-delinquency issued by the corresponding Tax Prosecutor's Office.
    5. Receipt of payment law 33-91 for a value of RD$ 10.00 from the General Directorate of Internal Taxes.
    6. Two (2) stamps of RD$ 30.00 each, for the application form for the oath.
    7. Photocopy of the Identity and Electoral Card.
    8. Photocopy of the Degree granted by the University.
    9. Fill out the form with your data and bring your request (original and 2 copies) addressed to the President and others.
    10. judges of the Supreme Court of Justice, requesting a hearing to be sworn in as an attorney.
