Article 150 of the Constitution of the Republic establishes that the law shall regulate the legal status of the Judicial Career, the admission, training, promotion, promotion, dismissal and retirement of the judge, in accordance with the principles of merit, capacity and professionalism; as well as the retirement and pension system of judges, officials and employees of the judicial order. It is regulated by Law No. 327-98 of Judicial Career dated August 11, 1998. Administration of the Judicial Career The Council of the Judicial Power, as established by the Constitution of the Republic, is the permanent body for the administration of the Judicial Career.
The Supreme Court of Justice, in accordance with the transitory provisions, shall maintain the functions attributed to the Council until it is integrated. The administration of the judicial career shall be regulated by the Organic Law of the Council of the Judiciary, the Judicial Career Law and other regulations created for this purpose. The Council of the Judiciary shall have the following functions:
- To present to the plenary of the Supreme Court of Justice the candidates for appointment, determination of hierarchy and promotion of the judges of the different courts of the Judicial Branch, in accordance with the law.
- Disciplinary control over judges, officials and employees of the Judicial Branch with the exception of the members of the Supreme Court of Justice.
- The application and execution of performance evaluation instruments for judges and administrative personnel of the Judicial Branch.
- The transfer of judges of the Judicial Branch.
- Other functions conferred by law.
