The Plenary met and learned about the progress of the work carried out by the judges' commission in charge of the legislative agenda of the Judicial Branch, which was appointed on March 11, 2021.
During the session, issues were discussed such as the mechanism for inter-institutional interaction to respond to the various consultative proposals emanating from the National Congress regarding the justice sector, in accordance with the mandate of the Constitution, which gives the SCJ a consultative role when it comes to this matter, combined with the power of legislative initiative within the same subject matter enshrined in the constitutional regulations.
In addition, a guide was approved containing the technical parameters for the creation of the courts, which, as discussed, will govern as an institutional policy.
Also discussed was the need to prioritize an order of legislative proposal that will enhance the modernization of the Judiciary regarding the adaptation of the Organic Law of the Supreme Court of Justice, the Judicial Organization Law, the Cassation Law and other issues that aim and pursue the consolidation and strengthening in favor of the administration of justice as the axis of strength.
Within the framework of the meeting, several consultative petitions were heard, on the occasion of requests made by the Justice Committee of the Chamber of Deputies in different areas of the legislative work.
Likewise, it was submitted and approved to hold a seminar on the subject that concerns the legislative agenda, with the participation of the legislative and executive branches, in matters of common interest, always in accordance with the principle of interdependence that must prevail between the branches of government, without detriment to the function of each one and the rules that must prevail.
During the session, a constructive dialogue was held on the various issues raised in the integration of the Plenary, in which there was consensus from the point of view of socialization in a scenario of strengthening the institutional order.
The purpose of these socializations is to place the judiciary at the apex of a performance in line with the trend of modernization of its internal and jurisdictional structures, in order to respond to the demands and needs of today's society.
The Legislative Agenda Commission of the Judicial Branch is formed by the presiding magistrate Luis Henry Molina Peña and magistrates Manuel Alexis Read Ortiz, Francisco Antonio Jerez Mena, Justiniano Montero Montero, Rafael Vásquez Goico and Napoleón Ricardo Estévez Lavandier, members of the Plenary of the Supreme Court of Justice.
